What are the differences between a Leased pub, Tenancy pub or Freehold?

It’s really important that you take the time to choose the right agreement for you. Your agreement will allow you to develop the best possible pub business for your chosen pub. This may be a drink led pub, a mixed bar and food offer or even a restaurant.

Whichever agreement you decide to choose, there are pros and cons for both, so here we share a quick overview for you to help you make the right decision.

Pub tenancy agreement

Pub tenancy agreements are usually a "full tie" but they might vary depending on the pub company. A "full tie" means you must acquire stock from the pub landlord, such as ales and cider, as well as other beverages. Tenants who have signed a "partial tie" agreement will have more freedom to buy products from other suppliers. If the pub is owned by a brewery, you can be sure that you'll be contractually obliged to sell the brewery's products!

  • You rent a pub from a brewery or pub company, it is your business and you will enjoy all of the profits from your hard work
  • You're a sole proprietor who employs everyone in the company.
  • You have shared responsibility for repairs to the property
  • You cannot sell on the goodwill of the business (*Goodwill is the value built up over time that is earned when the business is sold)
  • Typically, a short-term agreement (3-5 years)
  • The amount of money a pub estimates you'll need is referred to as “ingoings”. These are generally listed on each pub's leasing details and vary from pub to pub. The sorts of charges you may anticipate to see are usually comprised of a security deposit, working capital, stock on-site and fixtures and fittings. The ingoing costs vary from pub to pub.

Pub lease agreement

Leasehold operations grant the right to occupy and trade within premises for a set length of time in exchange for the payment of rent, subject to several conditions. Leasehold agreements can last anywhere from 10 to 25 years, during which time the lessee is obligated to pay the landlord rent.

Leasehold arrangements are readily transferable, which means they can be bought and sold on the open market with the landlord's approval.
